1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the ApexMail email infrastructure platform operated by Bel Consulting OÜ, a company incorporated in the Republic of Estonia.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
2. Definitions
- “Service” means the ApexMail email API, dashboard, and related tools.
- “Customer” means the entity or individual agreeing to these Terms.
- “Data” means any content submitted to the Service by the Customer.
- “Consumer” means a natural person acting for purposes outside their trade, business, craft, or profession.
3. Service Description
ApexMail provides transactional and marketing email sending infrastructure, including APIs, SMTP relay, email analytics, deliverability tools, and compliance features.
4. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials.
5. Acceptable Use
Use of the Service is subject to our Acceptable Use Policy. Violation may result in immediate suspension or termination.
6. Data Processing
We process data in accordance with our Privacy Policy and Data Processing Agreement, compliant with GDPR and applicable Estonian and EU data protection law.
7. Payment Terms
Fees are billed monthly or annually as selected. All prices are in EUR (displayed as equivalent USD amounts on the pricing page for convenience). Estonian VAT (24%) applies where required.
7.1 Automatic Renewal
Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial periods.
7.2 Price Changes
We may change pricing with 30 days’ notice via email. Continued use after the notice period constitutes acceptance of the new pricing.
8. Right of Withdrawal (EU Consumers)
If you are a Consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU.
8.1 How to Withdraw
To exercise the right of withdrawal, you must notify us of your decision by sending a clear statement to support@apexmail.ee. You may use the model withdrawal form below, but it is not obligatory.
8.2 Effect of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we receive your withdrawal notice. Reimbursement will be made using the same means of payment used for the initial transaction.

8.4 Exception
In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to the supply of digital content or services where performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. By creating an account and starting to use the Service, you expressly consent to the immediate start of performance and acknowledge that you lose your right of withdrawal.
9. SLA
Scale and Enterprise plan customers are covered by our Service Level Agreement. Other plans are provided on a best-effort basis with no guaranteed uptime commitment unless otherwise agreed in writing.
10. Limitation of Liability
To the maximum extent permitted by applicable law, ApexMail’s total liability shall not exceed the fees paid by you in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.
11. Governing Law and Disputes
11.1 Governing Law
These Terms are governed by the laws of the Republic of Estonia.
11.2 Dispute Resolution
Any disputes arising under these Terms shall first be submitted to the Harju County Court, Tallinn, Estonia.
11.3 Online Dispute Resolution (ODR)
Pursuant to Regulation (EU) No 524/2013, EU consumers may submit complaints to the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
11.4 Supervisory Authority
Without prejudice to other administrative or judicial remedies, you have the right to lodge a complaint with the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon): https://www.aki.ee
